Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Pixel Boost iPhone application (the “App”) provided by Zhang Fan (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The Service

Pixel Boost is a photo utility application for iPhone that allows you to upscale and reframe images you already own into social-ready assets and print-ready files. Typical use includes Social Pack (~2×) and Print Pack (~4×) workflows, on-device enhancement, user-supplied overlays, and export to Photos or Files. The App processes images primarily on your device and does not post content to social networks.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on an Apple device that you own or control, solely for your personal or internal business purposes, in accordance with the App Store terms and these Terms.

4. User Content

You retain all ownership rights in the images, logos, QR codes, text, and other materials you import or create within the App (“User Content”). You are solely responsible for ensuring that you have all necessary rights to use, process, and export your User Content. We claim no ownership of your User Content.

5. Free and Pro Access

The App is offered on a freemium basis. Additional features are available through a paid subscription or in-app purchase (“Pro”) via Apple’s StoreKit. Subscriptions automatically renew unless canceled under Apple’s rules. All payments are processed by Apple; we do not receive or store your payment card details.

6. Advertising (Free Users)

Free users may see non-blocking advertisements (for example, via AppLovin) on certain transition screens. Pro users do not receive advertisements on those placements. Personalized advertising may require App Tracking Transparency (ATT) permission.

7. Acceptable Use

You agree not to use the App for any unlawful purpose; reverse-engineer the App except as permitted by law; interfere with the App; process content you lack rights to use; or circumvent Free/Pro access controls.

8. Intellectual Property

The App (excluding your User Content) is owned by Zhang Fan or its licensors and is protected by intellectual property laws.

9. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT RESULTS WILL MEET YOUR SPECIFIC REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Zhang Fan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App. Total liability shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim, or USD $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Zhang Fan from claims arising out of your User Content, your use of the App, or your violation of these Terms.

12. Changes; Termination

We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance. We may suspend or terminate access if you violate these Terms. You may stop using the App at any time.

13. Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts located in Singapore, except where prohibited by applicable law or Apple’s App Store terms.
