Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Pixel Form iPhone application (the “App”) provided by Zhang Fan (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The Service

Pixel Form is a photo utility application for iPhone that allows you to upscale and reframe images you already own into social-ready assets and print-ready files.

Typical use includes:

• Selecting a Social Pack (approximately 2× upscale and multiple social formats) or Print Pack (approximately 4× upscale and print outputs);
• Importing images from the Photos library or Files;
• On-device image enhancement and composition;
• Adding user-supplied overlays (logos, QR codes, watermarks, stamps, signatures) and editable text;
• Exporting social formats to Photos or print PDF/PNG to Files or Photos;
• Storing project records in a local Library.

The App processes images primarily on your device. It does not generate commercial brand assets (such as logos, QR codes, official stamps, or signatures) for you—you must supply those. The App does not post or publish content to any social network. Platform names (e.g., Instagram, TikTok, Xiaohongshu, WeChat, etc.) are trademarks of their respective owners; Pixel Form is not affiliated with or endorsed by them.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on an Apple device that you own or control, solely for your personal or internal business purposes, in accordance with the App Store terms and these Terms.

4. User Content

You retain all ownership rights in the images, logos, QR codes, text, and other materials you import or create within the App (“User Content”).

You are solely responsible for ensuring that you have all necessary rights, licenses, and permissions to use, process, and export your User Content. You represent that your User Content does not infringe any third-party rights and does not violate applicable law.

We claim no ownership of your User Content. As between you and us, your User Content remains yours.

5. Free and Pro Access

The App is offered on a freemium basis. Certain features are available without charge (“Free”). Additional features and higher-capacity workflows are available through a paid subscription or in-app purchase (“Pro”) via Apple’s StoreKit.

Subscriptions automatically renew unless canceled in accordance with Apple’s rules. You may restore previous purchases through the App. Pricing and feature availability are displayed in the App and may change. All payments are processed by Apple; we do not receive or store your payment card details.

6. Advertising

The current version of the App does not display third-party advertising. It does not request App Tracking Transparency (ATT) permission and does not track you across other companies’ apps or websites. If a future version introduces advertising, these Terms and our Privacy Policy will be updated before that version is released.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose;
• Attempt to reverse-engineer, decompile, or otherwise extract the source code of the App except as permitted by law;
• Interfere with or disrupt the App or its related systems;
• Use the App to process content you do not have the right to use;
• Circumvent any technical limitations or Free/Pro access controls.

8. Intellectual Property

The App, including its design, code, features, and branding (excluding your User Content), is owned by Zhang Fan or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks, logos, or other intellectual property.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that the results of image processing will meet your specific requirements.

10. Limitation of Liability

To the maximum extent permitted by law, Zhang Fan and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Our total liability for any claim arising out of these Terms or the App shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Zhang Fan and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the App, or your violation of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. The updated version will be indicated by a revised “Last updated” date. Continued use of the App after changes become effective constitutes acceptance of the revised Terms. Material changes may be notified through the App or other reasonable means.

13. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.

14. Governing Law

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts located in the People’s Republic of China, except where prohibited by applicable law or Apple’s App Store terms.
